Hi,

ich hab das bis 3. korrigiert! Mir kommt es aber so vor, als ob du das einfach in eine Uebersetzungsmaschine eingetippt haettest. Also versuch es erst mal selbst. Ich moecht naemlich nicht deine Hausaufgabe machen! Und zur Info, ich glaube Morpheus muss man jetzt bezahlen, die gibt es doch gar nicht mehr kostenlos??? 1. Introduction
“Is it now legal or illegal?” This is one of the most asked questions currently. Mostly the answers to those questions are not very precisely, and not even correctly answered. You get to hear several answers like “Of course is it legal, or why would you think that almost everybody does it?” up to “No, of course it’s not legal! Why should it be legal to steal something?”
So this ignorance, also from my side, was a reason for me to choose this topic for my interdisciplinary work on the project. After I write this work, I like to know what the rules and the legal regulations are.
Another reason for me to choose this topic, is that the questions, regarding downloading are very up-to-date. I think you can find something about (il)legall downloads almost every day. I began to realize this when I started to deal with this subject.
I needed a long time to find a suitable second thesis. I thought about the large number of musicians which are expressing themselves against illegal downloads, because their disk sales must suffer under the circumstances. So I asked myself: why do we still have access to illegal downloads when the music industry suffers so much? The only answer I could come up with is, that it must be very difficult to prevent it and therefore I’d like to find out why….






2. What and how to download?

2.1 What can I download?
Nowadays you can download various things in the internet. If you’re searching an old rare song, which your CD salesman doesn’t have, you will surely find it in the internet.
But there are other things you can download for free. If you’re looking for any text-document, you also will find it.Therefor you just need your download program. If you’re looking for a program or a pc-game which you’d like to buy, first thing you should try is the internet, whether it’s already uploaded or not. If that should be the case, you can download it for free. And the latest and also very popular things to download are movies. On secret pages you can find the newest cinema-movies to download for free! Often the films are available, before they are even played in the cinema. So you see, not only the music industry bears a loss.

2.2 How can I download?

Nowadays it’s very simple to download whatever you want! Even my grandmother could download a song of her beloved Pavarotti.
The first step is to find a download program in the internet, what isn’t a big of a deal, ‘cause there are a lot of them. For example you would find Morpheus, LimeWire or Kazaa. They are, as far as I know the most well-known download-programs. First you have to download and open it then you just type the name of the artist or the name of the song into the anticipated field. In a few seconds the program will find the song that you’d like to download. To download your song your computer needs a few minutes. (Depending on the speed of the computer and the internet connection) After the download you have the song on your non removable disk off your pc and you can hear the song as often as you want or you can burn it onto a disc.
Why would you still go into a shop, if everything can be so easy and you don’t even have to pay for it? Nevertheless you still should be anxious.

3. Beginning of the illegal downloads
An 18-year old boy called Shawn Fanning first had the idea to place files in the internet. That was in the beginning of the year 1999. In the middle of the year appeared the first version of “Napster”- the first exchange stock exchange in the internet. Investors assume a new business platform and promoted Napster with millions of dollar. Very soon after the establishment of Napster shot further exchange stock exchanges (Gnutella, KaZaa, etc.) like mushrooms from the soil. That was the beginning of illegal downloading.

On March 2001 a judge called Marilyn Hall Patel ordered that Napster has to take all copyright titles from the offer grant within 72 hours. That was the end of Napster and the fight against exchange stock exchanges began.
Nowadays Napster is again on-line but with the difference that you have to pay if you want to download a song.

4. Downloads around the globe



4.1 How much illegal music downloads where
there in the year 2004?


The number of illegal music downloads increased since the year 2000 considerably In the year 2000 were "only" 600 million illegal downloads in the year 2004 however nearly the double of that. That must be a very terrifying number for the whole music industry, because as more downloads, as less CD sales there are!


















The Swiss music industry suffered by the illegal download in the year 2004 losses of
25 million Franconia. And of cause of that the Swiss music industry lost since 2001 around 600 jobs.


4.2 What was downloaded most 2004?

DVD's are not pieces of the longing of the robbery copiers; maybe because you can copy the dvd’s or check-out counters them for few money.
But the cd’s together (only once- and again-recordably) constitute more than half of the illegal sound carriers. Tapes constitute still 25%.




4.3 In which countries are the most illegal downloads?

In Europe state the rather poorer countries the point of illegal downloads. Also the other with over 50% downloads of the entire music market are not very rich countries.
In the category “25-50% are some second world countries” of Europe and South Africa and Saudi Arabia represented.
Countries with a rate of under 10% illegal downloads are rather the rich countries, including Switzerland.
It can summarized be said: ever enrich a country, the less illegal downloads.

5. Download situation in Switzerland


5.1 Legal situation in Switzerland

Legal is: to download music files for itself and for people with one you are
closely connected. That means for friends and relatives. But the problem here is, that the law can’t say, if people you’ve become acquainted in a with (for example in a chat room) are “real” friends..





Illegal is: to offer files in an exchange stock exchange. Except if you offer own
files (own songs, own beats, etc.) for the exchange.

The problem is: If you use a program with peer-to-peer-possibility (p2p), (Kazaa, Morpeus, LimeWire etc.: Programs with those you can upload (offer a file) and download at the same time) is both: the download is legal, but the upload is forbidden. And you often can only use such a program, if other users also can download files from your computer.
Another dangerous thing is that you don’t know exactly what you download straight. It could be child , which is illegal too.


“Ignorance does not count before the court” is also in this case considerably!
That means if they get you, you can’t say: “I didn’t know that!”







5.2 Remaining unclear legal situation in Switzerland

The rest of the legal situation is still unclear. Various opinions exist over it:

• Most specialists are the opinion that downloading of in copyright matters
protected files is legal in Switzerland

• Open-Source-movements (people who want that all is for everyone) of course
do not want limit downloads by laws.

• The International Federation of the Phonographic Industry (IFPI) condemns all
illegal downloader. They also say that even if you download something for
yourself or for your friends must be forbidden.

• Some lawyers see the illegal downloads in a legal grey area because it doesn’t
exist an official law and it’s very hard to create one who’s blow and
unassailable.


5.3 (Legal steps) in Switzerland approximately against down- and up loader of

5.3.1 “Game over” (IFPI)

The International Federation of the Phonographic Industry (IFPI) started on 15 of November 2005 with an attack against the downloader of music files. They call their action “Game over”.
They control all music exchange stock exchanges and pursue all people who download illegal files, which would be almost every user…
Not equal legal steps are undertaken; they first want to give them the change to agree out of court. The users have to delete their “stolen” music files and they have to pay compensation.
The IFPI reported of first successes; over 50 procedures against private downloader’s are under way.

5.3.2 Goal of “Game over”

What the IFPI want to reach with her legal steps is to create a first judicial case.
That is only possible if an accused doesn’t pay compensation. If someone would dare to do this, it would come to a court process. The court decision of this court process would be the basis for a new law. Because after that decision can the prosecutor’s further downloader’s accuse, without big problems...

There exist already two cases (also launched from IFPI and SUISA) with court decisions from the year 2003, but obviously these weren’t sufficient.
























6. Situation in other countries

6.1 Legal steps in other countries

USA: In the USA stricter laws prevail: “The Record Industry Association” of America has in the last two years over 10’700 complaints submitted.

Europe and Asia: Since March 2004 approx. 1’700 people were sued. That happened in
three steps coordinated from the IFPI-headquarter in London.


6.2 Comparison with neighbouring countries
It is important to know what other countries do against illegal downloader, because internet is world-wide interlaces, so I think that all countries must look also a little bit on the others, at least on countries in direct proximity. And I think also, that if we see what others do, we can get some inputs and in reverse also.

















7. Download situation in Germany


7.1 Legal situation in Germany
In Germany is it also legal to download a file, to burn it on disk and to give them to friends.
But to upload files to other people is like in Switzerland forbidden, too.
On April 2005 “The International Federation of the Phonographic Industry” announced that they are contently with the result; 200 million less downloads in the year 2004 than in the year 2003 (in accordance with the “Brennerstudie 2005 of the Gfk). In the year 2003 528 million files were downloaded.

7.2 “Digital File Check” and legal procedures (Germany)
The IFPI-Section in Germany published an aid program called "Digital File Check", which searches exchange stock exchanges on the own PC and deletes them immediately. They are very content with the download rate of this program.
Since beginning 2004 they introduced legal procedures against illegal downloader’s. Up to now more than 2000 charges were placed. After the USA is Germany that country with the most charges. An illegal downloader in Germany has to pay on the average around 4’000 Euro.

7.3 Attac “Free music market” and other measures against illegal downloading
Attac, which is a international organisation of globalization opponents has another plan for the future of downloads. They want to legalize digital exchanging and to adjust the sinking incomes of musicians and industry by an alternative remuneration system: the musicians are to be recompensed after the number of downloads. The advantage of this system would after “attac” be; the little unknown bands can more easily their music under the people.

There are other measures in different countries. But they almost are the all the same. There hasn’t been founded until now a “real”, effective measure against the problem of illegal downloading.














8. Conclusion / My opinion

I learned a lot about downloading until I wrote my interdisciplinary work on the project, so I I think I reached the goal I had to reach.

I realised that there are too much illegal downloads around the globe (in some countries more then over 80%, especially in the third world). I think that this is very terrifying, because if it continues in such a way, it will times slam. It can not be, that almost everyone is listening to music which is “free”..!

I also find that the government reacted to slowly in the past! They should have from the beginning prevent the illegal downloads. Now it’s (too) late, and they have much bigger problems with that.

My second these was: “The music industry succeeds in only moderately preventing illegal Downloads.” I know now that this is false. It is very hard and difficult to do something against the illegal downloads, because it spread already very far and already too long.
But the government and other institutions are now fighting against them with adaptet and up-to-date means. I think in a couple of years there will be no more illegal download without paying a fee. And I see the downloading as a change for the little, unfamous groups, I foresee positively.
